GENERAL CONDITIONS OF CONTRACT
1. PARTIES INVOLVED
These Purchase Conditions are intended to regulate the relationship between BOUQUET D´ALELLA, S.L. and the client, regarding all transactions carried out in the online store of the company BOUQUET D´ALELLA, S.L.
Clients will be natural or legal persons who act as consumers.
Customers who make purchases in www.bouquetdalella.com, will have to register and will be accepting these conditions of purchase, so it is important that the customer read these conditions before making a purchase.
It will be an essential requirement for clients, in the case of natural persons, to be over 18 years of age.
The sale of alcoholic beverages of any strength to minors is prohibited.
3. SCOPE OF APPLICATION
These General Conditions of Purchase apply to the sale of all articles of BOUQUET D´ALELLA, S.L. through the website www.bouquetdalella.com to customers who acquire them within Spanish territory.
BOUQUET D´ALELLA, S.L. reserves the right to cancel a client’s access account if it detects fraudulent, speculative or bad faith acts in the use of the service.
BOUQUET D´ALELLA, S.L. informs you that it files the electronic documents in which the purchases are formalized.
4. HOW TO PLACE YOUR ORDER
Choose the product you want from our web store, indicate the desired quantity of product and add it to the cart using the “add to cart”button. Then go to the shopping cart where you will find the chosen product “VIEW CART“. If you need to modify the requested quantity of the same product, you can mark the desired number by clicking on “QUANTITY”.
If you want to choose a larger product, you must click on “continue shopping”.
When you have finished choosing the products and have all of them in your cart, you can finalize the purchase by clicking on the “FINISH PURCHASE” button.
If there is an offer, it will be duly identified and marked as such and the previous price and the price of the offer will be indicated.
In BILLING DETAILS, you must register by filling in your details and, if you need to, add a different delivery address to the billing address. You can review your order and later mark the option of the payment method you prefer.

The acquisition of the products through the activation of the “PLACE ORDER” button, expresses the total acceptance by the client of these General Conditions prior to the acquisition of the products, without any new features that may occur. in the clauses of the General Conditions later.
5. DELIVERY TIMES AND PRICES
Deliveries are sent to the address provided by the Customer within 72 business hours for deliveries to the Peninsula, the Canary Islands and the Balearic Islands for products in stock.
For deliveries within the European Union, the delivery time will be 4 business days, excluding Saturdays, Sundays and holidays from the calculation.
For deliveries in the United States, the period will be 4 weeks in normal times. While the problems related to the pandemic caused by COVID 19 last, the delivery period may be up to 7 weeks.
If you have requested the collection at the winery, it will be prepared for delivery on the agreed day and time.
The customer will have a period of 72 hours from the receipt of the merchandise to verify the integrity of all the components of the order and to verify that all the products are included in the requested order.
An order will be considered delivered when the Customer signs the delivery receipt, after 72 hours, the shipment will be considered accepted and claims for damages or related to the shipment will not be accepted.
In case of receiving a product damaged by transport, it must be indicated on the carrier’s delivery note, once the claim has been made, BOUQUET D´ALELLA, S.L. will be responsible for the collection of the defective product, proceeding to send another equal product in perfect condition at no additional cost to the customer, once the damaged item has been received back.
The prices of the products will appear reflected in the virtual store with VAT included. Products that are not available through the website will not have the price marked or will appear with “PRODUCT NOT AVAILABLE”. You can make the query through email email@example.com and, if you want to purchase it, you will be indicated the purchase process to follow.
Failure to comply with the delivery period will not be considered as the one caused by the absence or change of address of the recipient, unknown recipient or address, non-payment of postage, supplies or refunds, closure for holidays, late deliveries in second delivery attempt, force majeure. or fortuitous event or others not attributable to the carrier. Likewise, it is exempt from liability in cases of non-compliance with the delivery deadline for shipments to the Balearic Islands or international shipments for reasons beyond the control of the carrier (delays of airlines, shipping companies, carriers, loading and / or unloading …).
6. SHIPPING COSTS
The corresponding shipping costs will be indicated in the order.
The minimum order will be 6 bottles (1 box), and will have a minimum cost of 8.68€, for national shipments. For shipments to the Balearic and Canary Islands, the minimum cost will be 9.51€.
Before making the purchase, your shipping costs will be calculated automatically and the information will always be provided prior to making the payment.
Those products in which the collection in store is requested will not have a higher cost for the customer.
According to the Consolidated Text of the General Law for the Defense of Consumers and Users (TRLGDCU), Clients will have the right to withdraw from the contract without having to justify such decision and without penalty of any kind, within a period of 14 calendar days from the date of the receipt of the merchandise by the customer. For this, the conditions set out in the withdrawal form must be met and sent to the following email address: firstname.lastname@example.org, specifying in the subject RETURN followed by the order number.
The withdrawal has no cost for the client, BOUQUET D´ALELLA, S.L. will reimburse the corresponding amount, including the shipping costs corresponding to the initial delivery without undue delay and, in any case, within a maximum period of 14 calendar days from the date of receipt of the withdrawal form. The refund will be in the same way that the initial payment was received. However, BOUQUET D´ALELLA, S.L. you can stop the refund until you receive the merchandise.
The customer will only be responsible for the decrease in the value of the merchandise as a result of handling it other than that necessary to establish its nature, characteristics or operation.

The transport costs originated by the return of the product must be assumed by the Client as long as the return is purely due to the right of withdrawal and not to a lack of conformity of the product.
Once the withdrawal form has been received, the BOUQUET D´ALELLA, S.L. team will contact you within a maximum period of 72 hours to give instructions on how to make the return.
Once the merchandise has been received and verified that it is in perfect condition, we will proceed to refund the amount, which will be made with the same form of payment with which it was paid. The return will include the total amount of the payment received, including shipping costs, if any, with the exception of additional costs resulting from your choice of a different delivery method than the less expensive delivery method that we offer.
9. FORM OF PAYMENT AND GUARANTEE OF SECURE PAYMENT.

10. LIABILITY OF THE CLIENT
The client guarantees the veracity and accuracy of the data provided when filling in the contracting forms, avoiding causing damage to BOUQUET D´ALELLA, S.L. derived from their incorrectness.
